1. Agreement
By using the LocalBrand website (localbrand.com.au) or engaging our services, you agree to these terms. If you do not agree, please do not use our website or services.
LocalBrand (ABN 39 517 210 256) reserves the right to update these terms at any time. Continued use of the website or services constitutes acceptance of any changes.
2. Services
LocalBrand designs and builds professional websites for local businesses across Australia. We also offer monthly Care Plans (ongoing website maintenance and support) and the Local Authority Sprint (a comprehensive digital growth strategy package).
Our typical website build turnaround is five to seven business days from the date we receive a completed client brief and any required deposit.
3. Quotes and pricing
All prices published on our website and provided in quotes are in Australian Dollars (AUD) and exclude GST unless otherwise stated.
Written quotes are valid for 30 days from the date of issue. We reserve the right to adjust pricing for projects that fall outside the original scope of the quote.
4. Payment terms
A deposit of 50% of the quoted project fee is required before work begins. The remaining balance is due before the final website is published and made live.
Payment can be made by bank transfer or any other method agreed upon in writing. Invoices are issued electronically and payable within 7 days unless otherwise agreed.
5. Client responsibilities
To deliver your project on time, we need your cooperation. You agree to:
- Provide all requested content, images, logos, and branding materials in a timely manner
- Complete the onboarding brief form promptly and thoroughly
- Respond to review requests and provide feedback within 3 business days
- Ensure all content you provide is accurate and does not infringe on third-party intellectual property rights
Delays caused by late or missing client materials may extend the project timeline beyond the quoted turnaround.
6. Intellectual property
Upon receipt of full payment, you own all website code, content, copy, and design assets created specifically for your project. You are free to host, modify, or transfer your website to any platform or developer at any time.
LocalBrand retains the right to display the completed work in our portfolio and case studies unless you request otherwise in writing.
Any third-party assets (stock images, fonts, plugins) used in your project remain subject to their respective licence terms.
7. Care Plans
Care Plans are monthly subscriptions that cover hosting, security, maintenance, and (depending on tier) content updates and performance reporting.
Care Plans can be cancelled with 30 days written notice. Upon cancellation, we will assist with the transition of your website to alternative hosting if requested. Care Plans require an active LocalBrand-built website.
8. Exclusivity guarantee
For Local Authority Sprint engagements, we guarantee that we will not work with any direct competitor of yours within 12 months of delivering your growth pack. This exclusivity is limited to the specific competitors identified in your report and the specific market or service area analysed.
9. Revisions
All standard website builds include one round of revisions after the initial preview is delivered. A "round" constitutes a single consolidated set of feedback provided within 3 business days of receiving the preview.
Additional rounds of revisions or changes to the agreed scope will be quoted separately and must be approved in writing before work proceeds.
10. Limitation of liability
LocalBrand will take all reasonable care in delivering our services, but we do not guarantee specific business outcomes such as search engine rankings, lead volume, or revenue increases.
To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the total fees paid by you for the specific project in question.
We are not liable for any indirect, incidental, or consequential damages, including loss of profit, data, or business opportunity.
11. Termination
Either party may terminate a project engagement by providing written notice to the other party. If you terminate a project after work has commenced:
- The deposit is non-refundable, as it covers research, planning, and initial development work already completed
- If the project is more than 50% complete at the time of termination, the full project fee may be payable
LocalBrand reserves the right to terminate an engagement if the client is unresponsive for more than 30 consecutive days, or in cases of abusive or unreasonable conduct.
12. Governing law
These terms are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of the courts of Australia.
